• Article 61 of the Indian Constitution: It provides for procedure for impeachment of the president for violation of the constitution by impeachment.
• The charges: The charges shall be preferred by either House of
Parliament. No such charge shall be preferred unless- o The proposal to prefer such charge: Is contained in a resolution which has been moved after at least fourteen days notice in writing signed by not less than one-quarter of the total number of members of the House has been given of their intention to move the resolution.
o Type of majority required: Such resolution has been passed by a majority of not less than two-thirds of the total membership of the House.
• It is then sent to the other house. The other house investigates the charges that have been made.
o During this process, the president has the right to defend oneself through an authorised counsel.
o If the second house also approves the charges made by a special majority again, the president stands impeached and is deemed to have vacated their office from the date when such a resolution is passed.
• No president has faced impeachment proceedings so far.
• Legal immunity:
